Brendan Henry, Esq. is Senior Counsel, Incident Response, Security, Litigation at The Beckage Firm, where he advises organizations on data privacy, cybersecurity, and complex regulatory and litigation matters. His practice is informed by more than seventeen years in senior legal, oversight, and compliance roles across the federal government, combined with earlier legislative service and private‑sector litigation experience.

Brendan spent nearly two decades in federal service, including roles with the Department of Defense’s National Security Agency, the Department of Homeland Security’s Office of Intelligence and Analysis, and the Department of the Interior in Alaska. In these positions, his work focused on intelligence oversight, information sharing, and the safeguarding of sensitive data, with particular emphasis on cybersecurity and national security matters. His senior roles included serving as Acting Chief of the Privacy and Intelligence Oversight Branch at DHS and as a Senior Compliance Officer at NSA, where he focused on cybersecurity compliance and Foreign Intelligence Surveillance Act Section 702 issues.

Earlier in his career, Brendan served as a legislative staff attorney for the Texas State House and built a litigation‑focused private practice, representing clients in complex disputes and appeals before transitioning into federal service.

Incident Response

As a member of The Beckage Firm’s incident response team, Brendan supports organizations through all phases of cybersecurity and data privacy incidents. His work includes advising on containment and remediation, guiding internal investigations, supporting forensic engagements, and helping clients navigate regulatory notification and reporting obligations.

Brendan brings substantial incident response experience from his federal service, where he led and supported responses to data breaches involving sensitive and classified information. His background includes managing breach investigations, advising on secure interagency information sharing during incidents, and leading multidisciplinary teams responding to high‑impact cybersecurity events. At The Beckage Firm, he applies this experience to help clients reduce risk, restore operations, and strengthen governance following significant incidents.

Litigation and Investigations

Brendan’s litigation practice draws on experience from both private practice and senior government service. He has handled complex disputes, appeals, regulatory inquiries, and matters involving privacy and national security legal issues. His background includes work in mediation and other alternative dispute resolution forums, as well as litigation through trial.

At The Beckage Firm, Brendan supports clients facing cybersecurity, privacy, and government investigation matters, combining litigation strategy with deep regulatory insight. He focuses on helping organizations assess legal risk, respond effectively to investigations and claims, and achieve practical, defensible outcomes in complex and evolving legal environments.

Regulatory and Communications Practice

Brendan’s practice focuses on advising communications, technology, and critical infrastructure organizations on cybersecurity governance, regulatory compliance, and national security–related risk. His work is grounded in deep familiarity with the legal and operational frameworks governing large‑scale, highly regulated information systems.

Drawing on his work at the National Security Agency, Brendan advises on issues informed by Section 702 of the Foreign Intelligence Surveillance Act, including lawful data collection, compliance oversight, and the development and implementation of rules governing cybersecurity operations. His practice addresses the legal and operational challenges of managing high‑volume, data‑driven systems under sustained regulatory scrutiny, particularly where national security considerations intersect with commercial operations.

Brendan regularly counsels clients on the collection, use, sharing, and safeguarding of sensitive data, with particular attention to cybersecurity risk, compliance controls, and defensibility in the face of advanced nation‑state threats. He advises on incident response, regulatory engagement, and governance structures for organizations operating in complex and highly scrutinized environments.
